Domestic Abuse Protection Order
A Non-molestation Order
This is a civil injunction aiming to stop someone from using or threatening violence against another person with whom they have or have had a relationship. Threatening behaviour includes intimidating, harassing or pestering the person. The domestic abuse order may state that the person is not allowed to contact the other party or come within a certain distance of them. Breaching this order is a criminal offence.
An Occupation Order
A civil injunction that regulates who can live in the family home. The order can temporarily remove the abuser’s right to live in the home and can also restrict them from entering the area surrounding the home. A power of arrest is attached to the order in case the order is breached.
