Being sacked from your job can come as a huge shock and is usually a distressing experience, the legal term for being sacked is dismissed. If you feel you have been subjected to an unfair dismissal, we offer legal advice to clients throughout North Wales, particularly in Caernarfon.
You may feel you have been unfairly dismissed but from a few exceptions only employees with two years’ unbroken service that have been dismissed can bring an unfair dismissal claim.
Unfair dismissal is about fairness and your employer may be able to show that the reason for your dismissal (or principal reason) was a potentially fair reason.
Potentially fair reasons include:
- Capability (this could include long absence through ill health.
- Conduct (this could include gross misconduct),
- Breach of statutory restriction
- Some other substantial reason
and the employer acted reasonably in all the circumstances in concluding that reason was sufficient for dismissal.

Many people confuse Wrongful Dismissal with Unfair Dismissal.
It is very different to Unfair dismissal, which is about ‘why’ you were dismissed (the fairness).
Wrongful dismissal is more about ‘how’ you were dismissed.
A good example would be an employee being dismissed without the proper notice (the how) which has nothing to do with the reason for the dismissal (the why).
